ESTATE AND TRUST PLANNING

Creating a will and appointing an executor is the easiest and most basic way to carry out your wishes, and to protect and dispose of your assets. However, things may become more complicated as greater wealth is accumulated, businesses or foreign assets are involved, or if there are special considerations or unconventional personal situations involving certain family members.  Greater wealth often means increased exposure to probate and other taxes and administration costs.  Without proper planning, an estate's value can be dramatically reduced for one's beneficiaries.

At Taylor Estates Law we can provide the support and knowledge necessary to craft an estate plan contingent to your unique situation.  Our approach is relaxed and personal; we take the time to fully understand your personal and financial circumstances and to elucidate your most private thoughts and aspirations in regards to your legacy.

We work closely with clients and other professional advisors to develop intelligent estate plans which reflect the complexities of life - such as marriages, divorces, second marriages, death of a spouse or birth of a child, minor or disabled beneficiaries, accidents, addictions, loss of capacity and long-term care - ensuring that health care wishes are respected, that legacies are carried out and that those who you leave behind are placed on a secure path forward.

ESTATE ADMINISTRATION

Many people accept being named as an executor in a friend's or family member's will, without fully understanding the nature and scope of what this responsibility entails.  We can assist executors in all facets of trust and estate administration, from the basic requirements of paying debts and taxes, reporting to beneficiaries, selling estate property and winding up estates, to dealing with uncommon situations which require sound judgement and a solid understanding of the applicable estate, tax and family laws.

We can also assist in all manner of probate applications, including where unusual grants of probate and administrative bonds are required; for example, probating of foreign wills, proving a photocopy of a will where the original has been lost, and appointing an executor not named in the will.  We understand the importance of getting around these types of hurdles quickly and efficiently, so that the estate's administration can be completed and the beneficiaries can receive their inheritance.

ESTATE LITIGATION

In our litigation practice, we often see the costly effects of dying without a proper estate plan or having a competent executor to administer one's estate.  Dying with a "basic" cookie-cutter will or an out-of-date will can in many cases be worse than dying intestate.  All of this can make the job of being an executor much more difficult and stressful, particularly when the failure to plan leads to conflict among those left behind. Executors may also be blindsided when claims are made against the estate by creditors, beneficiaries, family members or others who come out of the woodwork to assert an interest in the estate.

At Taylor Estates Law, we can assist in resolving disputes between executors, trustees, beneficiaries, and attorneys for property and personal care.  Understanding that the true sources of conflict often trace back to family relationships and human emotions, we seek to assist our clients in de-escalating conflict whenever possible - to prevent disputes from derailing an estate's administration and to ensure that the wishes of the deceased are carried out and respected.  We provide strong client-focused advocacy and always strive to achieve the best results in the most efficient and cost-effective manner possible.
